MEMORANDUM OPINION Plaintiff David Cole (“Mr. Cole” or “Plaintiff”) initiated this action against the National Institute of Standards and Technology (“NIST”) and the Federal Emergency Management Agency (“FEMA,” together “Defendants”) under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552. See Compl. for Injunctive Relief, ECF No. 1. Mr. Cole claims that Defendants have made an inadequate search for and disclosure of records responsive to his 2011 FOIA request related to the collapse of the World Trade Center (“WTC”) on September 11, 2001.
